Claim time limits
If you are considering making a claim, it must be brought within three years. This will start to run either from the date on which the injury occurred or from the date on which the person injured first had knowledge of the injury.
There are few exceptions to this limitation period. One notable exception refers to claimants who are less than 18 years of age. In this case, the three-year period will not commence until the claimant reaches 18 years old.
How long will my claim take?
This is a question that cannot be answered distinctively. As each case will be different and assessed on its own merits.
As a guide, straightforward claims with simple injuries, where liability is not disputed are likely to settle after 6 to 8 months.
Again with regards to simply road accidents, many insurers make settlement offers within weeks instead of months.
How much compensation will I get?
There are two types of compensation that you could receive as a result of your claim - general damages and special damages.
General damages will be paid to compensate you for your injury, this will vary depending on the seriousness of your injury, the pain and suffering that the injury causes you and any loss of future earnings.
Special damages can be awarded for any financial loss between the dates when the injury occurred up to the date of the hearing itself. The idea of this compensation is to put you back into a position you were in prior to the injury (financially).
